Is a Winner of The 10th Philippine Web Awards Guilty of Plagiarism?

A few hours ago, an anonymous source provided Technograph with evidence of apparent plagiarism by Einsteinarts.com. The Arts and Portfolio winner of the 10th Philippine Web Awards uses the same platform located at 24-7media.de/os/popup.html. The “fully functional web template” is currently being sold for $3,000.

Technograph approached Einstein S. Gan, the owner of the site, for clarification. Mr. Gan admitted that his portfolio site was an imitation, but stressed that it was purely accidental and that he “didn’t really knew [sic] about the 24-7media site.” He also claimed that he “added all my own actionscipts, icons, content, background, etc for my own site. I know the skin still looks very much the same to the site you have provided…That’s because I was using it as a template for my own site.”
The guidelines of the PWAs clearly state that “The entry must not be plagiarized in terms of content and design from a copyrighted source, such as another Web site.” Is Einsteinarts.com guilty of plagiarism? If so, then Media Gateway Inc., the organizers of the Philippine Web Awards, have broken their own rules. Admittedly, the definition of plagiarism in the visual sense has been confused by the proliferation of free website and blog themes. Technogra.ph uses the Semiologic theme, a highly-customizable platform that many other websites use.
In any case, it is clear that Media Gateway should look into this matter further. At the very least, they need to clarify their guidelines for next year’s competition. Read Technograph’s other articles on the 2007 Philippine Web Awards.

Does it mean that the scores published at Googlepages are the real scores but, since it was published without PWA consent, is unauthorized?
Still, PWA-Media G8way people are mum on the real issues here. Why? Are they afraid that no designers and developers will join next year’s Philippine Web Awards? Are they afraid they cannot gain profit next year which could potentially make Media G8way bankrupt? Yet they have time to check http://punongbayanaraullo.googlepages.com/ of its authenticity rather than taking time to answer all issues and controversies raised by the participants.
The PWA-Media G8way people even have time to lurk and read all comments posted on blog sites containing PWA controversies rather than focusing on the real issues.

bullshit pala ang web awards na yan, yung mga iba pinaghirapan website nila tapos disqualify lang nila because of some certain reasons… Tapos many did not follow the rules and regulations of the contest, and now still PWA didnt post the scoresheets, hayy, tama sabi nila puro lutung macao ang PWA, sayang naman mga contestant na may talento.

loosers? eh di naman ako kasali, every year ko lang inaabangan etong web awards na to. Isa rin ako designer pero di ko trip sumali sa PWA na yan. Halos lahat ng top designers alam na palakasan system lang yang PWA kaya di sila sumasali, besides kung sumali ako eh di sana nadaya din ako. Reality check alam ko taga web awards ka and yung iba dito eh taga webawards, iniiba nyo lang screen name nyo, pero actually kayo rin yan, you just keep defending yourself eh sira na credibilidad nyo. You can’t even show the contestant the scoresheets.. WTF! Where’s the tally of votes??? Display nyo sa website nyo! Website nga ng PWA eh napaka panget, 2006 pa yung title instead of 2007, kakahiya kayo!
Anyway, to all the contestants, masanay na kayo kasi di na bago ang dayaan at lutuan sa PWA. All they want is your money! Lahat ng designers and developers na sumali sa PWA eh mahuhusay, yun nga lang natalo sila ng isang template.. Kesyo di daw cya aware, ulol eh obvious na copya lahat. Gamitin mo naman creativity mo! Paganahin mo naman utak mo sa pag program mo ng sariling script, puro copy paste script lang ginawa mo without knowing the functions of those scripts!
Anyway I support all the contestants, lalo na yung nagpakita ng effort! Yung mga nag cheat eh sinusumpa dapat!
Dont worry wala pake alam ang PWA dito kasi they all have the money in their pockets..
